FRESH VOICES LLC

Submission Agreement

1. I hereby grant Fresh Voices LLC and its officers, employees, contractors, industry affiliates/partners, sponsors, readers, consultants and competition judges (collectively, “Fresh Voices”), the right to read, evaluate, score and judge the material I am submitting (the “Material”).
2. I warrant and represent that I am the sole owner of all rights to the Material and have the full authority to submit the Material to Fresh Voices.  Or, if I am not the sole owner of the Material, I warrant and represent that I have obtained permission from all other owners to submit the Material.
3. I understand that Fresh Voices will not disclose, or share my material with any third party without my prior written consent.
4. I understand that I may be required to sign other agreements before Fresh Voices undertakes any promotional efforts on my behalf.
5. I acknowledge that it is solely my responsibility to register the Material with the U.S. Copyright Office prior to submitting it to Fresh Voices. 
6. I hereby indemnify Fresh Voices from and against any and all claims, loss or liability (including attorneys’ fees and costs) that may arise in connection with the Material.
7. I attest that I have read, understand and agree to all the official rules and eligibility requirements of the writing competition (the “Competition”), and all rules relating to screenplay consultation (“Consultation”).
8. I understand all rules, eligibility and prizes of the Competition are at the sole discretion of Fresh Voices and may be changed at any time without notice.
9. I understand all decisions of the Competition judges are final.
10. I understand that nothing in this Submission Agreement shall be deemed a sale or offer for sale of the Material.  Fresh Voices’ only obligation is to read, evaluate and judge the Material submitted for the Competition, and/or to provide the consulting services I select if I am submitting the Material for consultation.
11. I understand that script analysis is a subjective process, and that there can be reasonable disagreement as to the merits of the Material.  I understand and acknowledge that except as set forth in Section 12, all fees are non-refundable, whether I agree or disagree with Fresh Voices’ evaluation.
12. I understand that Fresh Voices has the right to refuse services in connection with the Material. Should the Material be refused, Fresh Voices will refund any pre-paid amount in full.
13. To the fullest extent permitted under applicable law, I fully release Fresh Voices from any and all present and future claims relating to Fresh Voices services, the submission of the Material, the Competition, Screenplay Consultation, and this Agreement.
